Escrowly Terms of Service
By opening, participating in, or completing an Escrowly escrow deal, all parties agree to the terms below. If you do not agree, do not proceed.
1. Eligibility
You must be legally allowed to enter transactions in your jurisdiction. You are solely responsible for complying with local laws, taxes, platform rules, payment-network rules, and age restrictions. Escrowly may refuse, cancel, dispute, delay, or close any deal at any time for safety, compliance, operational, or risk reasons.
2. Prohibited Deals
- Stolen, hacked, or unauthorized accounts or assets.
- Fraudulent payments or chargeback abuse.
- Illegal goods or services.
- Impersonation, phishing, social engineering, or scam activity.
- Anything that violates Discord Terms of Service or applicable law.
If staff reasonably suspects a prohibited deal, the deal may be frozen, cancelled, disputed, or reported without warning.
3. Escrow Scope
Escrowly acts only as an escrow intermediary for the transfer of funds. Escrowly does not inspect, verify, endorse, or guarantee what either party claims to be selling or buying. Both buyer and seller accept that all trade decisions are made at their own risk.
4. Payment Rules
Only payments sent to the wallet or invoice provided by Escrowly for that specific deal count toward escrow. Sending funds to any other address, old invoice, edited address, fake bot, impersonator, or third party is your own responsibility. Underpayments, overpayments, wrong-network deposits, unsupported-token deposits, delayed confirmations, and blockchain or network issues may delay or invalidate the transaction.
5. Release Rules
Funds are released only after the buyer confirms satisfaction, or staff intervenes under these terms. Once funds are released on-chain, the action is final and irreversible. The buyer is fully responsible for checking delivery, access, functionality, ownership, and correctness before approving release.
6. Refunds and Disputes
Refunds are not automatic. Refunds require staff approval unless Escrowly explicitly states otherwise. If a dispute is opened, staff may request screenshots, chat history, proof of delivery, proof of ownership, payment proof, account history, or any other evidence they consider relevant. Staff may decide to release, refund, split, delay, or cancel a deal based on available evidence, risk signals, server policy, and overall safety concerns.
7. Evidence Standard
Escrowly may rely on any evidence it considers credible, including ticket messages, bot logs, transcripts, blockchain confirmations, screenshots, video recordings, user history, server moderation history, and external platform evidence. Failure to provide requested evidence may result in a ruling against you.
8. Fees
Escrowly fees are charged according to the bot and server policy shown at the time of deal creation. Fees may be a flat minimum, a percentage, or both. Blockchain and network fees are separate and may reduce payout amounts or affect payment totals. Fees are generally non-refundable once the escrow process has begun, except where staff explicitly decides otherwise.
9. Account and Security Responsibility
You are responsible for securing your Discord account, wallets, devices, emails, 2FA, recovery methods, and linked services. Escrowly is not liable for losses caused by compromised accounts, malware, SIM swaps, phishing, fake screenshots, social engineering, or user negligence.
10. Limitation of Liability
Escrowly, its owners, staff, moderators, developers, and affiliates are not liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from any deal or attempted deal. This includes losses related to fraud, impersonation, delivery failure, market movement, wallet mistakes, blockchain delays, irreversible transfers, downtime, miscommunication, or user misconduct.
11. Staff Authority
Staff decisions are final unless server ownership decides otherwise. Staff may freeze, close, archive, refuse, or manually resolve any deal when they believe it is necessary for safety, fairness, compliance, or server protection. Abuse of staff, false claims, forged evidence, pressure tactics, or harassment may result in deal loss, bans, or denial of future service.
12. Acceptance
By opening a ticket, remaining in a ticket, clicking any agreement button, sending payment, or otherwise proceeding with a trade, you acknowledge that you have read, understood, and agreed to these terms in full. If you do not agree, do not use Escrowly.
